HOLIDAY RENTAL AGREEMENT

 

 

2. Both parties agree to sign this contract with the following clauses for the holiday stay contracted and that appear in the reservation data.

1 Property

 

1. The holiday rental property is located in the municipality of Agaete, Spain, in Puerto de las Nieves, specifically Calle Nuestra Señora de las Nieves nº 35.

2 Maximum guest capacity 

 

 

That said, the maximum capacity of each accommodation is defined below:

 

2. In the case of renting the house located on the second floor with the name White & Blue House the maximum capacity is 8 people (6 adults + 2 children from 0 to 3 years), you can have 1 free cot for children from 0 to 3 years, but there is no possibility of extra bed in this case.
3. In the case of renting the house located on the third floor with the name White & Blue Rooftop the maximum capacity is 3 people (2 Adults + 1 child from 0 to 17 years) you can have 1 free cot for children from 0 to 3 years or 1 extra bed free for children from 0 to 17 years
4. In case of non-compliance with the number of people listed in the initial reservation and / or exceed the maximum capacity established of the accommodations, an additional charge of € 30 per person per night will be made since the beginning of the rental and we also reserve the right to ask you to leave the property for breach of contract and in this case the refund will not be made for the days not enjoyed.

3 Rental term

 

1. The rental period begins at 15:00 pm on the date of Check In that appears in the reservation with the entrance to the property and ends at 11:00 am hours on the date of Check Out that appears in the reservation after the departure of the property.
2. If it is not possible to check-out on time and this means a delay in cleaning and therefore affects the entry of other customers to the accommodation, a delay fee of € 100 may be applied, unless the late Check Out is previously agreed between the parties.

4 Minimum stay

 

1. This property requires a minimum stay of 4 nights. The minimum stay may be longer in holiday seasons.

5 Price

 

- Cleaning at the end of your stay 

- Water and electricity costs up to a maximum of € 80 / month for long stay reservations

- Clean bed linen and towels for your stay

- Use of high speed Wifi connection

 

1. The valid payment methods are those established on the Booking, Airbnb platforms and in case of direct bookings on our website www.agaetewb.com via Credit Card at the time of booking.

7 CANCELLATION POLICY

 

1. In case of direct reservations on our website www.agaetewb.com we only accept cancellations with 2 month (60 days) of advance comunication before the date of arrival.
2. If you need more flexibility when booking, on other platforms such as Booking or Airbnb you can make the reservation with free cancellation for an additional reservation cost (% of Booking and Airbnb profit).

8 CLEANINGS

 

1. Please note that the price of the stay includes only cleaning upon departure.
2. In case of requiring additional cleaning during the stay, the cost of this is:
   1. White&Blue Rooftop Floor 3 = 100 €
   2. White&Blue House Floor 2 = 120 €

Note: Additional cleaning includes full cleaning of the accommodation, change of sheets and towels.

3. In case of requiring other services, the costs are as follows:
   1. New Bed Linen Set = 30 €
   2. New Towel Set (for 2 people) = 30 €
4. For long-term rentals the required cleanings will be managed separately and the cost will depend on the needs of the client, contact us by email agaetewb@gmail.com

9 PETS

 

1. Dogs are only allowed in the apartment on the second floor (White&Blue Rooftop) upon request and express confirmation.
2. It will have an additional cost per dog and day to be able to assume a deep cleaning after your visit. 
3. Payment per pet will be made during booking.
4. In case of staying with your furry, bring your bed and pots of food.
5. Pets are not allowed to climb sofas and beds, help us so that other tenants do not find traces of your pet on their next visit, so we do not have to limit accessibility in the future for this type of inconvenience to other guests. 
6. As it is not always possible to have it watched, use the available blankets to protect armchair and bed in case it occurs to them to break the rules at some point.
7. We also have dogs and we want to be able to go on holiday with them.

 

 

1. Access to the property will be made by means of a key-free access code. 
2. Access instructions will be sent to you once you check in.

11 CHECK IN 

 

1. Check In will be done electronically and will be available from the time of booking.
2. Guests are required to show photo ID. 
3. The normal schedule to access the property will be from 15:00 to 20:00.
4. Please let us know in advance what time you are going to arrive so that everything is ready on time.
5. The time of entry from 20:00 is possible, but in case of problems during access with the code we can not guarantee a quick attention to solve it.

12 CHECK OUT 

 

1. The departure time will be between 10:00 and 11:00 in the morning.
2. The delay in the Check Out will suppose an additional cost of € 100 per hour, due to the loss of time of the cleaning team and the consequent delay of the guests of the accommodation who can not access due to the delay caused.

13 CONDITIONS FOR STAYS WITH CHILDREN

 

1. Children of any age can be accommodated.
2. Children 18 and older are considered adults at this property.
3. There is the possibility of requesting a cot or extra bed always upon prior request and express acceptance of the property.
4. For both accommodations there is 1 cot available (White&Blue Rooftop and White&Blue House) 
5. In the event that one of the accommodations is already booked and no request for a cot has been made, it will be possible to have the surplus cot and have 2 cots for the White&Blue House accommodation.
6. For the White&Blue Rooftop accommodation with a maximum capacity of 3 people (2 Adults + 1 child from 0 to 17 years old) you can have 1 free cot for children from 0 to 3 years old or 1 extra bed free for children from 0 to 17 years old.
7. For the accommodation White&Blue House of maximum capacity 8 people (6 Adults + 2 children from 0 to 3 years) you can have 1 free cot for children from 0 to 3 years, but there is no possibility of extra bed in this case.
8. All cots and extra beds are subject to availability.

14 AGE RESTRICTION

 

1. Minimum age to book 18 years.
2. All reservations must include at least one over 18 years of age.
3. Persons under the age of 18 can only be accommodated if accompanied by a parent or legal guardian.

15 VISITS DURING THE STAY

 

1. The number of guests is not allowed to exceed 6 people, at any time, this may be a reason for termination of the contract between the parties and after confirming this situation, via surveillance cameras in common areas, we will ask you to leave our establishment and the money of the proportional part not enjoyed will not be returned for damages and breach of this contract.

It is not allowed that the visits spend the night in the accommodation and this may be a reason for termination of the contract between the parties and after confirming this situation, via surveillance cameras in common areas, we will ask you to leave our establishment and the money of the proportional part not enjoyed in concept of damages and breach of this contract will not be returned.

16 DAMAGES

 

1. We understand that there are always unforeseen events and if you accidentally cause damage to the accommodation during your stay please let us know via email agaetewb@gmail.com or via WhatsApp at +34 640 693 970 with a brief description and photos to be able to repair it as soon as possible and that it does not affect your stay or that of future guests.
2. In the event that the damages caused were of greater importance than simple normal wear and tear, damages that cause the cancellation of future stays of other guests, crimes (such as theft) and / or their nature shows misuse or negligence, the amount of the repair plus 20% will be rebilled for repair management. And as proof we will send invoice of the repairer or the purchase of the damaged element or materials.
3. Depending on the nature and cost of the damage we reserve the right to initiate a (legal) claim against you outside the conditions on damages.
4. In the event that the damages are serious for the accommodation, that endanger people or that may affect future reservations this is a reason for termination of the contract between the parties and after confirming this situation, we will ask you to leave our establishment and the money of the proportional part not enjoyed will not be returned as damages and breach of this contract.

17 Smokers / Non-smokers

 

1. Smoking is not allowed anywhere not even on the terraces.
2. The accommodation has smoke detectors connected by Wifi in case of activation, for security measures we will activate the emergency protocol and prior notice we will access the house to ensure that there has been no fire outbreak.
3. In case the smoke detector has been activated by tobacco fumes this may be a reason for termination of the contract between the parties and after confirming this situation, we will ask you to leave our establishment and the money of the proportional part not enjoyed in concept of damages and breach of this contract will not be returned in addition to an extra € 120 to finance a deep cleaning of the accommodation.

18 Events

1. It is not allowed to carry out any type of event that may generate annoying noises to the neighbors.
2. It is not allowed to hold any type of event outside the established quiet hours from 20:00 to 8:00 am.
3. It is not allowed to hold parties, bachelor parties or similar parties.
4. It is not allowed to play music with a volume above what is established by the regulations.
5. In case of breach of any of the above points this may be a reason for termination of the contract between the parties and after confirming this situation, we will ask you to leave our establishment and the money of the proportional part not enjoyed in concept of damages and breach of this contract will not be returned in addition to an extra € 120 to finance a deep cleaning of the accommodation.
